However, you acknowledge that no electronic device, telecommunications system, GPS technology or safety product can guarantee operation, detection of an emergency, successful communication or a particular outcome in every situation.

- supervision or care arrangements;
- medical advice;
- emergency preparedness; or
- directly contacting emergency services where required.
These Terms explain:

"Nominated contacts" means the people selected by a customer to receive alerts or communications generated by a device.
5. Website Use

- accessing support information; and

You must not:

Personal Alarms Australia does not guarantee that use of a device will:
- prevent harm;
- prevent falls;
- reduce risk in every situation; or
- result in assistance being received.
7. Orders and Contract Formation
7.1 Placing an Order
When you place an order through the Personal Alarms Australia website, you are making an offer to purchase the selected products under these Terms.
After submitting an order, you will receive an order confirmation email acknowledging that we have received your order.
This acknowledgement does not necessarily mean that your order has been accepted.
7.2 Acceptance of Orders
A contract between you and Personal Alarms Australia is formed when we confirm acceptance of your order, which may occur when:

You are responsible for providing a complete and accurate delivery address.
If delivery issues occur due to incorrect information supplied by you, additional delivery costs or delays may apply.
10. Returns, Refunds and Consumer Guarantees

Our procedures relating to returns, refunds and exchanges are contained in our Returns & Refund Policy.
Customers should review this policy before purchasing.
10.2 Australian Consumer Law
Personal Alarms Australia complies with the Australian Consumer Law.
Nothing in these Terms, our Returns & Refund Policy, or any other policy operated by PAA excludes, restricts or modifies any rights or remedies available to you under Australian Consumer Law where those rights cannot legally be excluded.
Our products come with guarantees that cannot be excluded under Australian Consumer Law.
Where a product has a major failure, you may be entitled to:
- a replacement;
- a refund; or
- another remedy available under law.
Where a product has a minor failure, we may repair or replace the product in accordance with our legal obligations.
11. Warranty
11.1 Warranty Coverage
Personal Alarms Australia provides warranty coverage for products supplied by us as follows:
Personal Alarm Pendant
24 months from the date of purchase
All Other Devices and Products
12 months from the date of purchase
The warranty applies to defects in materials or workmanship arising during normal intended use.
Where a product is found to have a defect covered by warranty, Personal Alarms Australia may, subject to applicable law:
- repair the product;
- replace the product; or
- provide another appropriate remedy.
Warranty claims must be submitted in accordance with our warranty and returns procedures.
11.2 Warranty Exclusions
To the extent permitted by law, warranty coverage does not apply to damage, faults or failures caused by:
- accidental damage;
- misuse or improper use;
- neglect or failure to care for the product;
- normal wear and tear;
- dropping, impact or physical damage;
- exposure to excessive heat;
- exposure to conditions outside the product's intended use;
- unauthorised repairs, modifications or alterations;
- incorrect charging practices;
- use of unsuitable charging equipment;
- water damage caused by use outside specified conditions;
- damage caused by incorrect setup; or
- failure to follow operating, setup or maintenance instructions.
Nothing in this section limits any rights or remedies available to customers under Australian Consumer Law.
12. Customer Support
12.1 Email-Based Support
Personal Alarms Australia provides customer support primarily through email.
We do not operate a telephone support service.
We use email as our primary support method because it allows us to provide detailed assistance, including:
- written instructions;
- photographs;
- diagrams;
- videos;
- setup guidance; and
- troubleshooting information.
12.2 Customer Assistance Requirements
To allow us to provide effective support, customers should provide accurate information including:
- product model;
- description of the issue;
- photographs or screenshots where relevant;
- relevant settings; and
- troubleshooting steps already completed.
Customers remain responsible for following instructions provided and ensuring the device is correctly configured.
13. Personal Alarm Devices and Emergency Communication
13.1 Purpose of Personal Alarm Devices
Personal Alarms Australia supplies personal safety and communication devices designed to assist users with contacting nominated contacts and seeking assistance when required.
Products may include features such as:
- SOS emergency buttons;
- voice calling;
- SMS alerts;
- GPS location services;
- automatic fall detection; and
- other safety-related functions.
These features are designed to provide additional assistance and peace of mind.
However, you acknowledge that no electronic device, telecommunications system, GPS technology or safety product can guarantee:
- detection of every emergency;
- successful communication in every situation;
- accurate location information at all times;
- detection of every fall; or
- a particular outcome following activation of the device.
14. Emergency Response Limitations
14.1 No Monitored Emergency Response Service
Personal Alarms Australia does not provide a monitored emergency response service.
Unless expressly stated otherwise:
- Personal Alarms Australia does not receive emergency alerts from customer devices;
- Personal Alarms Australia does not monitor whether a device has been activated;
- Personal Alarms Australia does not verify whether an emergency is occurring;
- Personal Alarms Australia does not contact emergency services on behalf of users; and
- Personal Alarms Australia does not guarantee that nominated contacts will respond to alerts.
Alerts generated by devices are sent according to the device configuration established by the customer, including nominated contacts.
14.2 Contacting Emergency Services
In an emergency situation where appropriate, users should contact emergency services directly by calling 000.
Customers acknowledge that a Personal Alarms Australia device is designed to assist communication and notification, but it is not a replacement for contacting emergency services directly.
14.3 No Guarantee of Assistance
Personal Alarms Australia products are designed to assist users in seeking help.
However, Personal Alarms Australia does not guarantee that:
- an alert will always be successfully transmitted;
- an alert will always be received;
- nominated contacts will respond;
- emergency services will be contacted;
- assistance will arrive within a particular timeframe; or
- use of the product will prevent injury, illness, loss or damage.
15. Device Operation and Reliability
15.1 Technology Limitations
You acknowledge that the operation of electronic safety devices may be affected by circumstances outside the control of Personal Alarms Australia.
Factors that may affect operation include:
- depleted battery;
- device damage;
- incorrect setup;
- incorrect settings;
- user error;
- insufficient mobile coverage;
- network outages;
- GPS limitations;
- environmental conditions;
- software or hardware faults;
- third-party service failures; and
- other factors affecting electronic communication systems.
15.2 Maximising Device Reliability
The best way to maximise the likelihood of successful operation is to:
- correctly set up the device;
- test all functions regularly;
- keep the device charged;
- maintain the device properly;
- keep contact details current; and
- follow all instructions provided.
Customers are responsible for ensuring they understand how their device works before relying on it.
16. Customer Testing and Setup Responsibilities
16.1 Testing Device Functions
Customers are responsible for testing their device before relying on it during an emergency situation.
Customers should test relevant functions, including where applicable:
- SOS button operation;
- voice calling;
- SMS alerts;
- GPS location reporting;
- fall detection;
- emergency contact notifications; and
- cancellation of false alarms.
Testing allows customers and nominated contacts to understand how the device operates.
16.2 Customer Configuration Responsibilities
Customers are responsible for ensuring:
- emergency contact details are entered correctly;
- contact details remain current;
- device settings are appropriate;
- the device is charged and operational;
- the user understands how to operate the device; and
- false alarms can be cancelled where applicable.
Personal Alarms Australia cannot monitor whether:
- a device is switched on;
- a device has sufficient battery;
- a SIM service remains active;
- settings remain unchanged;
- a device remains correctly configured; or
- the device is being used correctly.
17. SIM Cards and Telstra Network Requirements
17.1 SIM Card Requirements
Some Personal Alarms Australia devices require a compatible SIM card and mobile network service to operate.
Where required:
- customers may obtain a SIM card directly from a telecommunications provider; or
- Personal Alarms Australia may assist in facilitating the purchase of a Telstra SIM card.
Any SIM card or telecommunications service is provided by a third party and is subject to the terms and conditions of that provider.
17.2 Customer Responsibility for SIM Services
Customers are responsible for ensuring any required SIM service remains active and available.
This includes responsibility for:
- maintaining an appropriate mobile plan;
- ensuring payments are made when required;
- maintaining sufficient credit where applicable;
- keeping payment arrangements active; and
- ensuring the SIM service has not expired, been suspended or disconnected.
Personal Alarms Australia does not operate or control the telecommunications service and is not responsible for managing a customer's SIM account unless expressly agreed otherwise.
17.3 Mobile Network Coverage
Many Personal Alarms Australia devices rely on mobile network connectivity, including the Telstra 4G network where applicable.
Before purchasing, customers are responsible for confirming that suitable mobile network coverage is available in the intended area of use.
Customers acknowledge that:
- mobile coverage varies between locations;
- some locations may have limited or no coverage;
- network performance may change over time;
- telecommunications networks experience outages, maintenance and upgrades; and
- network availability is outside the control of Personal Alarms Australia.
Where suitable mobile network coverage is unavailable, a device relying on that network may not operate correctly.
18. GPS Location Services
18.1 GPS Technology Limitations
Some Personal Alarms Australia devices include GPS location functionality.
You acknowledge that GPS technology has inherent limitations and that location accuracy may vary depending on factors including:
- whether the device is indoors or outdoors;
- surrounding buildings or structures;
- underground locations;
- trees or other environmental obstructions;
- weather conditions;
- availability of GPS satellite signals;
- mobile network availability; and
- the position and movement of the device.
GPS accuracy is generally reduced indoors and in areas surrounded by tall buildings or other structures.
Accordingly, GPS location information provided by a device should be considered an approximate indication of location and should not be relied upon as an exact guarantee of a user's position.
18.2 Customer Responsibility for GPS Use
Customers are responsible for understanding the limitations of GPS technology before relying on location information provided by a device.
Personal Alarms Australia recommends customers test GPS functionality in the environments where the device is expected to be used and familiarise themselves with expected performance.
19. Fall Detection Functionality
19.1 Fall Detection Limitations
Some Personal Alarms Australia devices include automatic fall detection functionality.
Fall detection technology is designed to assist by identifying certain types of falls and triggering an alert where the device detects a possible fall event.
However, customers acknowledge that:
- fall detection cannot detect every fall;
- some falls may not be detected;
- some movements may incorrectly trigger an alert;
- false alarms may occur; and
- performance may vary depending on the circumstances of the event and how the device is worn or used.
Fall detection is an assistance feature only and should not be considered a guaranteed method of detecting all falls or ensuring assistance will be received.
19.2 Fall Detection Setup and Testing
Customers are responsible for correctly setting up, testing and adjusting fall detection settings before relying on this feature.
Customers should:
- test the fall detection function after setup;
- adjust sensitivity settings where available;
- confirm that settings are appropriate for the user's circumstances;
- understand how to cancel false alarms; and
- ensure nominated contacts understand how alerts may be received.
For some users, a higher sensitivity setting may be preferable, even where this results in occasional false alarms that can be cancelled by the user.
Customers are responsible for selecting settings appropriate to their individual circumstances.
20. Battery Performance and Charging
20.1 Battery Life Estimates
Battery life information provided by Personal Alarms Australia is an estimate only.
Actual battery performance may vary depending on factors including:
- mobile network signal strength;
- GPS usage;
- frequency of calls and alerts;
- fall detection activity;
- device settings;
- temperature;
- movement;
- age and condition of the battery; and
- environmental conditions.
Where a device has poor mobile reception, the device may use additional power while attempting to maintain connectivity, which may reduce battery life.
20.2 Customer Charging Responsibilities
Customers are responsible for:
- keeping the device charged;
- ensuring sufficient battery before use;
- following charging instructions;
- using suitable charging equipment; and
- arranging servicing or replacement where required.
A device with a flat or insufficient battery may not operate correctly.
Personal Alarms Australia cannot monitor battery levels or confirm that a device has sufficient charge.
21. Device Care, Water Resistance and Environmental Conditions
21.1 General Device Care
Customers must take reasonable care of their device to maximise reliability and lifespan.
Customers should:
- keep the device clean;
- protect it from unnecessary damage;
- follow supplied instructions;
- avoid modifying the device;
- inspect the device regularly for damage; and
- use the device only for its intended purpose.
21.2 Heat Exposure
Customers acknowledge that excessive heat may damage electronic devices and may affect waterproofing or water resistance.
Devices should not be exposed to excessive heat sources, including:
- very hot showers;
- hot taps;
- direct heaters;
- extreme temperatures; or
- other heat sources that may damage internal components.
Excessive heat may affect adhesives, seals or other components and may reduce or remove waterproof properties.
Damage caused by exposure to excessive heat may not be covered under warranty.
21.3 Water Resistance
Where a product is described as water resistant or waterproof, this refers to the product's intended level of protection under specified conditions.
Water resistance may be affected by:
- physical damage;
- wear and tear;
- exposure to excessive heat;
- improper use;
- modification; or
- deterioration of seals or components over time.
Customers must follow supplied instructions regarding water exposure.
22. Product Activation and Setup Responsibilities
Some Personal Alarms Australia products require setup, activation, configuration or programming before use.
Where setup assistance is provided by Personal Alarms Australia, customers remain responsible for:
- providing accurate information required for setup;
- confirming emergency contact details;
- testing the device after setup;
- ensuring the device is charged and operational;
- ensuring the intended user understands operation; and
- confirming the device functions as expected.
Personal Alarms Australia may provide reasonable assistance with setup; however, we cannot monitor whether:
- a customer completes setup correctly;
- settings are changed after setup;
- the device remains configured correctly;
- the device remains connected to a network; or
- the device continues to be used correctly over time.
Customers should test all relevant functions before relying on the device.
23. Third-Party Services
23.1 Third-Party Providers
Some Personal Alarms Australia products and services rely on third-party providers and infrastructure, including but not limited to:
- telecommunications providers;
- SIM providers;
- mobile networks;
- payment providers;
- delivery providers;
- software providers; and
- technology providers.
You acknowledge that these third-party services are outside the direct control of Personal Alarms Australia.
23.2 Third-Party Service Limitations
Personal Alarms Australia does not guarantee the availability, performance, reliability or uninterrupted operation of third-party services.
Third-party services may be affected by circumstances including:
- network outages;
- maintenance;
- upgrades;
- coverage limitations;
- technical failures;
- provider decisions;
- internet disruptions; or
- other circumstances outside our reasonable control.
Personal Alarms Australia is not responsible for failures, delays or interruptions caused by third-party services.
Nothing in this section limits any rights you have under Australian Consumer Law.
24. Customer Responsibilities and Acceptable Use
24.1 Responsible Use of Products
Customers agree to use Personal Alarms Australia products:
- only for their intended purpose;
- in accordance with supplied instructions;
- in a safe and responsible manner; and
- in compliance with applicable laws.
Customers must not:
- modify products without approval;
- attempt unauthorised repairs;
- damage or interfere with device operation;
- intentionally misuse emergency functions;
- use products for unlawful purposes; or
- interfere with third-party networks or services.
24.2 False Alarms
Customers acknowledge that false alarms may occur, particularly with features such as fall detection.
Customers are responsible for:
- understanding how to cancel false alarms;
- ensuring users know how the device operates;
- ensuring nominated contacts understand how alerts may be received; and
- configuring settings appropriately.
Repeated intentional misuse of emergency features may result in action being taken by Personal Alarms Australia, including limiting support where reasonably necessary.
25. Customer Communications and Conduct
25.1 Respectful Communication
Personal Alarms Australia is committed to providing professional and helpful customer support.
Customers agree to communicate with our team respectfully and reasonably.
We reserve the right to limit or refuse further communication where a customer engages in conduct including:
- abusive, threatening or offensive language;
- harassment of staff;
- unreasonable demands;
- excessive communication that prevents us from assisting other customers; or
- unlawful or inappropriate behaviour.
Where communication is limited, Personal Alarms Australia will continue to meet any legal obligations owed to the customer, including obligations under Australian Consumer Law.

- trademarks;

28. Limitation of Liability

Personal Alarms Australia supplies products designed to assist users with personal safety, communication and seeking assistance.
You acknowledge that:
- electronic devices may experience faults;
- batteries require charging and maintenance;
- mobile networks may fail or become unavailable;
- GPS technology has limitations;
- fall detection may not detect every fall;
- alerts may not always be delivered successfully;
- nominated contacts may not respond;
- environmental conditions may affect performance; and
- no technology-based safety product can guarantee a particular outcome.
Customers are responsible for:
- correctly setting up their device;
- regularly testing functions;
- maintaining the device;
- keeping the device charged;
- ensuring SIM and network requirements are met; and
- using the device in accordance with instructions.
28.2 Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or any other applicable legislation where those rights cannot legally be excluded.
28.3 Limitation of Liability
To the maximum extent permitted by law, Personal Alarms Australia is not responsible for losses, damages or delays arising from matters outside our reasonable control, including:
- telecommunications failures;
- mobile network outages;
- GPS limitations;
- incorrect setup;
- insufficient battery;
- failure to maintain the device;
- misuse of products;
- inaccurate customer information;
- third-party service failures;
- failure to follow instructions; or
- circumstances where the technology does not perform as expected.
Where permitted by law, Personal Alarms Australia's liability relating to products or services supplied by us will be limited to the remedies available under applicable law.
29. Indemnity
You agree to indemnify and hold Personal Alarms Australia harmless from claims, losses, damages, liabilities, costs or expenses arising from:
